These Terms & Conditions govern the use of the Atelier House UK website and the provision of services by Atelier House UK (“Atelier House”, “we”, “us” or “our”) to businesses, designers, brands and other professional clients (“the Client”, “you” or “your”).

By engaging Atelier House for any service, you agree to these Terms & Conditions together with any quotation, proposal, specification or project agreement provided to you.

1. About Atelier House

Atelier House UK is a couture development and production house based just outside London. We provide services including garment development, pattern cutting, sampling, fitting, fabric and trim sourcing, technical development, production, CMT manufacturing, production management and related consultancy and creative services.

Where agreed with the Client, Atelier House may also provide guidance relating to brand development, marketing, launch planning, supplier relationships and other services connected with bringing a fashion collection to market.

The specific services, deliverables, costs and timescales for each project will be agreed with the Client before work begins.

2. Consultations and Initial Enquiries

Initial enquiries and consultations are used to understand the Client’s requirements, proposed collection, development stage, budget and production requirements.

A consultation does not constitute an agreement for Atelier House to undertake development or production work unless confirmed separately in writing.

Any initial recommendations or discussions are provided based on the information available at the time and may be subject to further assessment once designs, fabrics, quantities, technical requirements and production specifications have been reviewed.

3. Quotations and Project Approval

Before commencing substantial work, Atelier House will provide the Client with a quotation, proposal or project specification where appropriate.

This may include:

• Development and sampling fees

• Pattern cutting and grading costs

• Fabric and trim costs

• Production costs

• Minimum order quantities

• Technical pack or development fees

• Additional services

• Estimated timescales

• Delivery or shipping costs

• Any applicable third-party costs

Quotations are based on the information provided by the Client and may be subject to change where specifications, quantities, materials or requirements change.

A project will be considered approved once the Client has confirmed acceptance of the quotation or proposal and, where required, paid the relevant deposit or initial payment.

4. Design Development

Atelier House can work from sketches, technical drawings, reference garments, images, inspiration, patterns or other information supplied by the Client.

The Client is responsible for ensuring that all designs, images, artwork, logos and other materials supplied to Atelier House may lawfully be used for the intended project.

Where Atelier House develops a design based on the Client’s instructions, the Client remains responsible for ensuring that the final design does not infringe any third-party intellectual property rights.

Development may involve several stages, including pattern cutting, toile development, sampling, fitting, amendments and final approval.

Changes requested after a stage has been approved may incur additional charges.

5. Samples, Toiles and Fittings

Samples and toiles are produced for the purpose of developing and assessing a garment.

The number of samples, fittings and amendments included within a project will depend on the agreed scope of work.

Additional samples, fittings or amendments outside the agreed scope may be charged separately.

The Client is responsible for providing timely and accurate feedback and approvals. Delays in providing feedback, measurements, approvals or materials may affect the agreed production schedule.

6. Fabrics, Trims and Materials

Atelier House may source fabrics, trims, buttons, fastenings, labels, packaging and other materials on behalf of the Client.

Where materials are sourced through Atelier House, the Client will be responsible for the agreed cost of those materials unless otherwise stated.

Fabric availability, colour, dye lots, print placement, texture and other characteristics may vary. Natural and specialist fabrics may also have inherent variations which are not considered manufacturing defects.

Where the Client supplies materials, the Client is responsible for ensuring that sufficient quantities and appropriate specifications are provided.

Atelier House is not responsible for delays or defects resulting from materials supplied or approved by the Client.

7. Production

Production will commence once the relevant designs, samples, specifications and quantities have been approved by the Client and any required payment has been received.

Production quantities, minimum order quantities, lead times and costs will be agreed on a project-by-project basis.

Estimated production dates are provided in good faith and may be affected by fabric availability, supplier lead times, production capacity, shipping, customs, third-party suppliers or circumstances outside our reasonable control.

Where production is undertaken through external manufacturing partners, Atelier House may manage or coordinate the relationship on the Client’s behalf.

8. Production Management

Where Atelier House provides production management services, we may coordinate aspects of the manufacturing process, including communication with suppliers, production schedules, material sourcing, sampling, quality checks and delivery arrangements.

The extent of production management will depend on the service agreed with the Client.

Atelier House may work with manufacturing and sourcing partners in the UK and internationally, including in China, France and Vietnam.

Where third-party manufacturers or suppliers are used, their own terms, capabilities and lead times may apply.

9. Technical Packs and Documentation

Where agreed, Atelier House may prepare technical packs, specifications, measurements, grading information and other production documentation.

The scope and level of detail included will depend on the service agreed.

Technical documents are prepared based on the approved design and information available at the time of production.

Any changes made after approval may require additional development work and charges.

10. Marketing and Brand Support

Where agreed as part of a project, Atelier House may provide guidance or support relating to brand development, marketing, launch planning, content, positioning or other commercial activities.

Such services are advisory unless expressly agreed otherwise.

Atelier House does not guarantee particular sales, commercial results, media coverage, customer numbers or other business outcomes arising from marketing or brand advice.

11. Pricing and Payment

All fees and costs will be communicated to the Client before the relevant work is undertaken wherever reasonably possible.

Payment terms will be specified in the relevant quotation, invoice or project agreement.

Atelier House may require a deposit or advance payment before commencing development, sourcing or production.

Unless otherwise agreed, work and production may be paused where invoices remain unpaid.

Additional work requested by the Client outside the agreed scope may be charged separately.

All prices are subject to VAT where applicable.

12. Changes and Cancellations

Once development, sourcing or production has commenced, cancellation or substantial changes to a project may result in charges for work already undertaken, materials purchased, samples produced, manufacturing commitments and other costs incurred.

Where materials have been specially sourced or ordered for a Client, those costs may remain payable even where the Client subsequently cancels the project.

Any cancellation should be made in writing.

13. Approval of Final Garments

The Client is responsible for reviewing and approving samples, specifications, measurements, fabrics, colours and other production details before bulk production begins.

Once a sample or specification has been approved, Atelier House will proceed on the basis of that approval.

Any changes requested after approval may result in additional costs and changes to the production schedule.

14. Quality and Defects

Atelier House takes reasonable care to ensure that garments are produced in accordance with the approved specifications.

Manufactured garments may contain minor variations arising from fabric characteristics, dye lots, production processes or the nature of the materials used.

Where a genuine manufacturing defect is identified, the Client should notify Atelier House within [7/14] days of receiving the relevant goods, providing details and photographic evidence where appropriate.

Atelier House will assess the issue and, where appropriate, work with the Client to determine a reasonable resolution.

15. Intellectual Property

Unless otherwise agreed in writing, intellectual property supplied by the Client remains the property of the Client.

This includes designs, logos, artwork, technical drawings, brand assets, patterns and other proprietary materials supplied by the Client.

Where Atelier House creates original patterns, technical documents, artwork or other materials as part of a project, ownership and permitted use will be determined by the relevant quotation or project agreement.

The Client may not reproduce or commercially use Atelier House’s proprietary materials beyond the agreed scope without written permission.

16. Confidentiality

Atelier House understands that Clients may provide confidential information relating to new collections, designs, fabrics, suppliers, production methods, pricing, launch plans and business strategies.

We will treat confidential Client information appropriately and will not knowingly disclose it to third parties except where necessary to fulfil the agreed services or where required by law.

Where appropriate, the Client may request a separate confidentiality or non-disclosure agreement.

17. Photography and Portfolio Use

Atelier House may wish to photograph garments, development work or completed projects for use on its website, social media, portfolio, marketing materials or other promotional channels.

We will seek the Client’s permission before publicly identifying a Client, brand or collection unless otherwise agreed.

If a Client does not wish their project or garments to be photographed or used for promotional purposes, this should be communicated to Atelier House in writing.

18. Third-Party Suppliers

Atelier House may work with external suppliers, manufacturers, mills, embroidery houses, printers, couriers and other specialist partners.

We will take reasonable care when selecting and managing third-party partners but cannot be responsible for circumstances outside our reasonable control.

Where a third-party supplier is contracted directly by the Client, the Client will be responsible for that supplier relationship.

19. Delivery and Shipping

Where Atelier House arranges delivery, shipping costs and arrangements will be agreed with the Client.

Delivery dates are estimates unless expressly guaranteed in writing.

Atelier House is not responsible for delays caused by couriers, customs, international shipping, strikes, adverse weather, supplier delays or other circumstances beyond our reasonable control.

20. Limitation of Liability

Nothing in these Terms & Conditions excludes or limits liability that cannot legally be excluded or limited under applicable law.

Subject to this, Atelier House will not be liable for indirect or consequential loss, loss of profit, loss of sales, loss of business opportunity or loss of reputation arising from a project, except where such liability cannot legally be excluded.

Any specific limitation of liability applicable to a project should be set out in the relevant quotation or project agreement.

21. Force Majeure

Atelier House will not be responsible for failure or delay caused by circumstances beyond our reasonable control.

This may include, but is not limited to, natural disasters, fire, pandemic, industrial action, supplier failure, material shortages, transport disruption, customs delays, changes in law, war or other circumstances affecting production or supply.

Where such circumstances occur, Atelier House will communicate with the Client and take reasonable steps to minimise the impact on the project.

22. Website Content

The information provided on the Atelier House website is for general information purposes.

While we aim to ensure that information is accurate and up to date, services, facilities, availability, production capabilities and other information may change.

Website content does not constitute a binding quotation or guarantee of availability.

23. Data Protection

Atelier House will process personal information in accordance with applicable UK data protection legislation and our Privacy Policy.

Information provided through enquiry forms, consultations and project communications may be used to respond to enquiries, manage projects, provide services and maintain business records.

24. Governing Law

These Terms & Conditions and any agreement between Atelier House and the Client shall be governed by the laws of England and Wales.

Any disputes arising in connection with these Terms & Conditions shall be subject to the jurisdiction of the courts of England and Wales, unless otherwise agreed in writing.

25. Changes to These Terms

Atelier House reserves the right to update these Terms & Conditions from time to time.

The most current version will be published on this website with the relevant date of update.

Any changes to the terms applying to an existing project will be communicated to the Client where required.
